1. Agreement to Terms

These Terms of Service ("Terms") govern all services provided by Lawn Butler ("Company," "we," "us," or "our") to you ("Customer," "you," or "your"). By scheduling, receiving, or paying for services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2. Scope of Services

Lawn Butler provides lawn care, landscaping, hardscaping, property maintenance, cleanup, and related outdoor services as described in written estimates, proposals, invoices, or service descriptions.

Services may include, but are not limited to, mowing, weed trimming, edging, blowing, shrub and hedge trimming, brush removal, landscaping, tree limb trimming, fertilization, herbicide applications, aeration, dethatching, overseeding, leaf removal, yard cleanups, snow removal, and other outdoor services.

Services are limited to areas that are reasonably accessible and safe at the time of service. Any work not specifically included in the approved estimate, proposal, or service agreement may result in additional charges.

3. Scheduling & Weather Policy

• Service dates and times are estimates and may change due to weather, equipment needs, staffing, or other operational circumstances.
• Rain, snow, wet or unsafe ground conditions, extreme heat, drought, severe weather, or other conditions outside of Lawn Butler's control may require services to be delayed or rescheduled.
• Weather-related delays do not qualify for refunds, credits, or guarantees of an exact service date or time.
• Lawn Butler will make reasonable efforts to maintain a consistent service schedule whenever weather and operating conditions allow.

4. Access to Property

Customers are responsible for providing safe and unobstructed access to all areas where services are scheduled. This includes, but is not limited to:

• Providing access through unlocked gates when necessary
• Keeping pets secured away from service areas
• Removing toys, hoses, decorations, and other objects from lawns and service areas
• Removing or identifying potential hazards
• Ensuring service areas are reasonably accessible

If access, safety concerns, or obstructions prevent Lawn Butler from completing scheduled services, the service may be skipped and may still be billed as scheduled.

5. Property Conditions & Damage Disclaimer

Lawn Butler will take reasonable care while performing services but is not responsible for damage resulting from hidden, undisclosed, or pre-existing conditions, including:

• Hidden sprinkler or irrigation components
• Underground wires, cables, or utility lines
• Rocks, debris, roots, or other concealed objects
• Uneven or unstable ground
• Soil, drainage, erosion, or turf conditions
• Pre-existing property damage
• Conditions outside of Lawn Butler's reasonable control

Minor turf marks, discoloration, rutting, or equipment tire marks may occur under certain conditions and are considered normal risks associated with outdoor property maintenance.

Any damage claim must be reported to Lawn Butler within 24 hours of the service being completed. Claims reported after this period may be denied.

6. Pricing, Payments & Billing

• Pricing is based on the property's visible condition, size, accessibility, and requested scope of work at the time of the estimate.
• Payment is due upon receipt unless otherwise stated in writing.
• Recurring services may be billed according to the agreed billing schedule.
• Late or unpaid balances may result in late fees, suspension of services, or collection efforts.
• Failed or declined payments may be subject to applicable processing fees.
• Completed services are non-refundable unless otherwise agreed to in writing.

7. Recurring Services & Cancellations

For ongoing or recurring services:

• Customers are requested to provide at least 72 hours' notice to cancel, pause, or reschedule a scheduled service.
• Services canceled without sufficient notice may still be billed.
• Services skipped because of customer-requested cancellations, lack of property access, or unsafe conditions on the property are not automatically eligible for a credit or refund.
• Seasonal service packages or recurring agreements may include minimum service commitments when specified in the agreement.

8. Estimates & Changes to Scope

Estimates and proposals are based on the property conditions and scope of work visible and known at the time of the estimate. Lawn Butler reserves the right to adjust pricing when:

• Actual property size or conditions differ from what was represented or observed
• The customer requests additional work or changes to the original scope
• Additional labor, equipment, disposal, materials, or services are required
• Hidden or unforeseen conditions affect the work

Lawn Butler will make reasonable efforts to notify the customer of significant pricing changes before performing additional work whenever practical.

9. Communication Consent

By engaging Lawn Butler for services, you consent to receive communications by phone, text message, or email regarding:

• Scheduling and service reminders
• Weather-related updates
• Service completion
• Estimates and proposals
• Billing and payments
• Customer service

Customers may opt out of non-essential communications at any time.

10. Limitation of Liability

To the fullest extent permitted under Missouri law:

• Lawn Butler will not be liable for indirect, incidental, consequential, or special damages arising from the services provided.
• Lawn Butler's total liability for any claim related to a specific service shall not exceed the amount paid for that specific service giving rise to the claim.

11. Customer Responsibility & Indemnification

The Customer agrees to indemnify and hold Lawn Butler harmless from claims, damages, losses, or expenses resulting from:

• Unsafe or undisclosed property hazards
• Customer negligence or failure to follow service instructions
• Failure to properly prepare the property for scheduled services
• Failure to disclose known underground utilities, irrigation systems, wires, or other hidden property conditions

12. Governing Law & Venue

These Terms shall be governed by and interpreted in accordance with the laws of the State of Missouri. Any legal action or dispute arising from these Terms or services provided by Lawn Butler shall be brought in a court of appropriate jurisdiction within Missouri.

13. Modifications to Terms

Lawn Butler reserves the right to modify or update these Terms of Service as needed. Continued scheduling, receiving, or paying for services after any changes are made constitutes acceptance of the updated Terms.
